If you are unfortunate enough to have been involved in a road accident you may be able to make a claim for a personal injury. This is compensation for the injury you have suffered and would also include any rehabilitation, physiotherapy or any other treatment prescribed as a result of the accident.
You can only claim compensation if the accident was not your fault. If you were the driver of the vehicle that caused the accident you are not able to claim compensation. If you were the driver or a passenger in a vehicle which did not cause the accident, you can make a claim. You can also make a claim against the at fault driver if you were a passenger in the car and suffered an injury.
Sometimes responsibility for the accident is split between two or more vehicles. In these cases your claim will be made against all other responsible parties, and a decision will be made as to how much will be apportioned to each one. In any case you will still receive one hundred percent of your compensation.
You can make a personal injury up to three years after the accident. However, this means that you can only issue proceedings against the third party within this time, so effectively you must start your claim within two and a half years so that medical evidence can be obtained.
To make an accident injury claim you will have to appoint an experienced lawyer to take on your case. Vamco has many years’ experience of all aspects of road accident claims and will ensure that your case is dealt with by a suitably experienced solicitor to ensure that you obtain maximum compensation from the third party.
